Yes, we all know there are some wackos out there, but last week when I heard on the news that they suspended a kindergartner, age 4, for playfully hitting his classmate on her rump, I'm beginning to think the system is getting alot sicker then the wackos.

I find it particularly interesting that a few years ago in the mid-west, a gril came into a classroom and started giving one of the male students a blowjob. The male student was suspended and faced criminal charges while the girl was sent to counseling to get over the horrible experience.

I wanted to know what the teacher was thinking when he saw her get on her knees, unzip the boy's pants, and begin giving the boy a blowjob. I wanted to know why the girl's parents were crying rape and sexual assault when clearly it was she who did the sexual assaulting. I wanted to know why only the boy was suspended and not the girl. None of these were adequately answered, just silence. And my comments on the news forum regarding that issue were mysteriously deleted. I never received a notice that I violated the tos, never received a reply e-mail explaining why the posts were deleted.

Initially, the papers stated that the boy made her and threatened her. Her parents insisted that the boy be prosecuted to the fullest extent of the law. But as the police did an investigation, it turned that she just wanted to give the boy oral sex. He never did anything to get her to do what she did, she volunteered. Later on, it came out that she had asked this boy out and he turned her down. She wanted to show him what he passed up.

The other thing that pisses me off is that there is no mistake of fact defense for statutory rape. With the way some of these girls dress and act, they make a very convincing 20-something-year old. In law school, I had such an incident occur to me. This really cute girl came up to me and started flirting with me. We talked and danced and made out all night long. The whole time, I was pretty sure she was at least 22. At the time, I was 24. She talked about college, professors, school subjects, etc. I often have to drop something my mother needs off at school. So I can tell the difference between a 16 year old and a 22 year old. It's pretty easy, but I was convinced. One of my friends, who is an ex-Philly cop thought she was telling the truth.

As it was time to leave, she pulls me to her girlfriends to say good bye and to explain to her mother that she stayed at one of the girls' houses and to make sure to deliver the absent note before homeroom tomorrow. I immediately let go of her and asked her how old she really was. She looked me right in the eye and said she was 22. I asked her why she needed to explain to mommy that she stayed at friends and what college required a homeroom and an absent excuse. Suddenly, she realized her mistake as realization and embarassment settled across her eyes.

I quickly left the building and never returned to that bar!

But assume I never had any hint that she was not 22 and we had sex. When it later came to light that I just had sex with a 16 year old... just that last phrase has such a damning sound to it you can't go on from there. As much as I understand the need to protect our young, especially girls at that age, I hate how a girl can get away with actively disguising their age and getting a man in trouble. It wouldn't matter that three of us were convinced that she was 22. It wouldn't matter that she was the one who initiated everything. It wouldn't matter that I was too drunk to think about checking her ID. And if I did check for her ID, I would be further suspect.

That and the bars I go to here are predominately for older crowds.

My criminal law professor, an ex-prosecutor, had a case where the girl was 15 and her boyfriend 16. The girl's parents wanted to press charges against the boy for statutory rape after finding out that their daughter had been sexually involved with her boyfriend. My criminal law professor said ok, and then had the daughter arrested right there. The father protested, and my professor said, well, she's equally guilty of the same crime and if I prosecute one, I have to prosecute the other, and she just freely confessed to having sex with a minor. Funny how the criminal complaint was dropped in that same instant.

Correct me if I am wrong, Swimmy -BUT- a Probation Officer told me that in order to press charges for Statutory Rape when a girl is over the age of 14, the girl has to sign a statement saying the boy FORCED her to have sex. A parent alone cannot press charges against the boy unless the girl signs this statement.

Then a whole can of worms can be opened up. If it was consenual and can be proven, the girl could be charged with a Felony for making a false statement.

The laws for Statutory Rape are not black and white as the average person thinks they are.

I do not know that. My criminal law professor was a prosecutor in Michigan. Perhaps they do things differently there, or the law changed to what the probation officer told you.
