Upon presentation of such recall petition to the council by the city clerk, the council shall thereupon order the holding of a special election for the purpose of submitting to the electors of the city or the district as the case may be, the question whether such officer shall be recalled. Such election shall be held not less than thirty (30) days, not more than sixty (60) days after the date of the certificate of the board of elections to the sufficiency of such recall petition; provided, however, that if any other election for any purpose at which all qualified registered electors of the city are entitled to vote, is to occur within sixty (60) days after the date of such certificate, the council may, in its discretion, order the holding of such recall election, and the consolidation thereof, with such other election occurring not more than sixty (60) days after the date of said certificate.
So from the city charter, it appears that the council has no choice but to hold a special election. And since fatata has stated the council never believed the recall procedures were valid or legal, it appears they're going to try and skirt their legal obligation. I smell a fresh Article 78 brewing! ;D

I smell a fresh Article 78 brewing! ;D It would probably behoove those working for Mr. Roefaro's recall to publicly ask the members of the Common Council about their views on this matter as soon as possible. The PR value alone should be priceless. After so many years of disappointment over the apathy in the area I think this recall movement is giving me some hope.

Hey guys, thanks for the support. The PEOPLE are behind this BIGTIME, the support is UNREAL! Every time City Hall opens their mouth it's like a commercial for us. This is REALLY happening and the support just continues to grow! It's an infection of hope!

The Dems want control of the County and this clown could very well be an obstacle for them. Can't wait to see it!

Well things are moving fast! One way or another the recall effort is going to shake things up. This is a golden opportunity for Larry to look like a hero by speaking out publicly on the side of the people! Come on Larry, screw your courage to the sticking place and come out from behind your desk. If you miss this one you will never be more than a "good guy" and an above average County legislator . Listen to the people, not Bill Morris!

What is it with all this push for Larry to say something? What about the other legislators? There are 28 others. I think Larry is doing the right thing and letting Utica fight its own fight. Though, I'm sure he'd be willing to sign the petition. Otherwise, this is a city issue, not a county issue.

Swimmy, You do have a partial point. Where are the other politicans from either party? This is a chance for some of them to come out and stand for the people. I guess what threatens one of them threatens all of them. As for Larry: he has vocally advocated reform , he has shown a willingness to publicly speak out in the OD, the question is, why wouldn't Larry speak up now when he was willing to do so before? As for this being a County issue, it is. See Strikeslip's Faultline blog on why the County is involved. Why is everyone speaking for Larry except Larry? Come on Larry, you could break the camel's back on this one.

He already has spoken out. When news of the appointment first broke, Larry was one of the first to voice his discontent. His exact words were that people would not want to know his true feelings but that the appointment was reprehensible and non-defendable. For whatever reason, the post is no longer there, but it doesn't be little the fact he spoke out against it. Even Rodwilson confirmed Larry has spoken out. What more do you want?
I've read strikeslip's blog. And the point is that there is more to the county than just Larry. Where is Picente or Deperno or the Chairman of the Board of Legislators (the one with the final legislative say) why aren't they talking? Where is Koziol who ran for county exec? Why isn't he speaking? Whabout the the Sherriff or the NYM chief of police since the civil service exam labella took was for the nym police chief position?
Larry already made is point early on. Maybe you should start singling out others instead of focusing solely on one person who has already made his position clear.

Agreed, 3 pm can't come fast enough. But until it is a county issue, it's really not necessary for any county officials to start butting into what so far has proved to be a city issue.
