One of the teens pled guilty today in county court after viewing the video of the assault of the cop. I give him credit for "manning up" but at the same time admonish him for his actions which were unexcusable. Then, family members start running their mouths in the hallway, trying to blame the store owner for selling him a cigar which started all of this. I'm sorry but I don't see the connection to a minor buying a cigar causing him to assault a cop. I guess that is right, he sold a minor a cigar and the minor went back in complaining that it was broke and when the owner would not replace it, the minor threw a hissy fit and flung the door open causing it to break. I guess all that was justified...GIMME A FRIGGIN BREAK!!!!! The kid admitted wrong, so is the family mad he admitted it because it was on video, or are they mad because he couldn't get a new one and was mad enough to hit a cop? So now the juvenile was found guilty and one of theother teens, hopefully the third will just plead too.

Maybe the family will sue the tobacco company?
Or maybe the manufacturer of the security camera that entrapped their precious little boy like that.

Entrapment only works if you were not pre-disposed to committing the crime, and there has to be some encouragement or involvement of the police. As for the family, I can't believe they would do that... Wait, yes I can. In today's "not my kid, my kid didn't do anything wrong" society, I'm surprised they haven't launched their own media campaign to cry out about the injustice being served on their innocent child, etc.
Glad the kid realized he wasn't going to be able to maintain his not guilty plea with video surveillance.

No, he was holding a press conference today demanding that Roger Clemens receive the same treatment as Sammy Sosa. He makes sense to me, actually.

Except for that issue, if he still makes sense, get some sleep.

No, I'm still good for another hour or so. That was the only point that made sense.

Didn't get to read the whole story but I'm hoping this kid didn't plead guilty for a lighter sentence. I hope the D.A. isn't playing that game with this incident. This kid, his brother and his Momma should all get the entire sentence that fits the crime. As far as I'm concerned no leniency or mercy allowed for this type of action.

I'm going to have to agree with wcup102 on this one. Regardless of what the store owner had done does not excuse or condone such a reckless action of assaulting a Police Officer.
Shame on the family for trying to turn the blame towards anybody else other than those hoodlums that decided to gain up on a Police Officer and beat him.
Maybe if the Officer capped off a couple of 9's in their ass (totally justified) that would be a sign that Utica PD is not playing anymore.
I've watched the video over and over again and every time it makes me sick and pissed off that not only did this take place but nobody stopped to help the Officer. Good thing I was not in the area with my 4-wheel drive truck I may have gotten distracted and accidentally run one, two or three of the tough guys over. Those of you wondering...yeeeep I sure would have felt terrible about it.
I hope they all get the 4-years in jail.

Him pleading guilty is probably the smartest thing that this kid has ever done.
The only sad part is that if he doesn't change his ways in the meantime, when he gets out he will be a more professional thug than when he went in.
But it will be a good place for him in the meantime!

wcup didn't say anything about a plea bargain so I'll wait to learn more.
I hope the kid wasn't witness to the scene outside the courtroom. Is it just me or do some people seem to need a little too much drama in their lives?

Sorry for incomplete details on my first post. The offer was 4 years and was facing 7 if convicted at trial. The officer involved was consulted prior to the offer being given and he had no problem with it and also wants to put the incident behind him. The officer stated he hope he(the defendant) learns from this and uses his jail time to better himself. The officer is a nice guy, I talked to him a while ago. He could not be shaken or stirred during the juvenile trial even when the defense tried to twist his words. He promptly and calmly corrected him. I, as Todd, am angered and sickened by the lack of assistance by all the bystanders. It says alot. One, the type of people that live in that area, and the lack of respect for law enforcement. Yes he would have been justified in shooting, but he told me that he was concerned that one of them would get his gun as they were grabbing for it in his holster. Those holsters are pretty secure, you really have to know how they work and get the right leverage to dislodge the gun.

Does anyone really think this kid and his family will learn a lesson because of the four year sentence? I THINK NOT! As far as I'm concerned four years is not acceptable and too lenient.
I'm sure the Officer involved is a very decent man and a good cop but in making his decision he could have sent a stronger message out to the public that attacking an Officer will not be tolerated in any form and you will be prosecuted to the limits of the law. That is a message that needs to be made loud and clear.
I'm not giving any credit to this punk for pleading guilty to a lesser sentence. He might be a punk but he's not that stupid. He knew if he went to trial he would get hung royally. All one has to do is watch the tape of the incident.
As a taxpayer I would not argue with the cost of his trial or the cost of his other family members involved because I know all would have been found guilty. Besides, there have been many other unwarranted trials for lesser crimes that we, the taxpayer, paid for.
I say enough is enough. Let's stop giving them a little vacation and start throwing the book at these offenders.

I can only hope this punk serves the entire 4 year REDUCED sentence and not released on parole after only serving 1/3 of his sentence which is usually the norm.
The "excuses" this boy's family came up with to justify his behavior and actions of assaulting a police officer says in all. This is the atmosphere these punks are brought up in from the time they were born - is it any wonder that when they get to the age of 12, their life's goal of becomming nothing more than a tough punk has already been engraved in their minds?
Trying to rehabilitate these types of hoodlums is impossible. They are not taught right from wrong by example or deed by their relatives. How do you expect the prison system to do it when they become an adult!
