Judge Dwyer sentenced second teen to 6 years in Prison for assulting the Police Officer a few months ago.
As Judge Dwyer stated, you just NEVER hit a Police Officer.
Maybe when this hoodlum gets out of jail, he'll remember to show more respect for a Police Officer.

Judge Dwyer is absolutely correct, if we want to have an effective police force. But the only way it works is for judges like himself to pile on the punishment. The hoodlum probably won't remember, but the next time he does he'll hopefully get 12 years. Or more.

Am I the only one who sees the irony that also today, the drunk that ran over the 11-year-old and left the kid brain-damaged for life only got 2 to 4 years?

No,Frank - see what I posted! I am as outraged as you that this drunk will be back out on the streets in probably 2 years and the first place he will head to will be a barroom where he can get drunk again and claim another victim on the highway.
Our legal system needs to be overhauled. A DWI conviction should be a black and white type of conviction. You are either drunk or sober and if you are drunk - you only have yourself to blame for being too stupid to not know when to stop drinking.
ALL of my sympathies lie with the victims of the DWI driver.

Either the drunk's sentence was too light or the teen's sentence was too harsh. I am in no position to judge. But the people who live in Cornhill have yet another reason to distrust authority and the legal system.

Frank, I know what you mean but I'm glad that the ones who assaulted the Police Officer got the book throw at them and I anxiously await their Momma's turn in front of the Judge. She is the one that should serve the most time. She raised her boys to disrespect the authority and jumped in during the attack showing her support for what her boys were doing. Stricter sentences when it comes to attacking an Officer of the law was long overdue. This is something I have stated right from the beginning. I've also said that the system was at fault because of the kid- gloving way they handled the criminal in the sentences they dealt out to them. Sh-t, Frank, most of the time the criminal is back out on the street before the arresting Officer finishes his report. Something is wrong with that picture. I agree with you that the drunk driver you spoke of should have gotten much more time but that's another case. Not fair to compare the two. I'm sure Tom Lindsey's and Joe Corr's murder had an affect on the sentences for these two kids and soon their Mother. Rightfully so. The laws have to be changed and the system has to keep pushing out those stricter sentences for all crimes. Maybe then there will be fewer second and third time offenders. We have to start some place and I'm sure this sent out a much needed message.

"the people who live in Cornhill have yet another reason to distrust authority and the legal system." What, people in Cornhill don't drink and drive and have serious accidents doing so? As a former bartender at Bobby T's on James Street, I can ASSURE you they do. It is a crime that happens there also as much as any other parts of this area and much more then killing or assaulting an Officer which they are guilty of all. If this punk's sentencing gives them the reasons quoted above then I am that one that is angry.

Well, if he had been smart and copped the plea he woul dhave only gotten four years.
I do think it may be a bit on the harsh side, but "Oh well".
The drunks sentence IMO is out of line, especially for a repeat offender.
He should have got 8-10 to dry out and re-think that last drink.

Ralph - I totally agree! 8-10 years for a repeat DWI offender that also seriously and possibly permanently injured a young boy should have been the MINIMUM sentence for this man.
This won't be the last time we see this man's name in the papers.

I dated one of Bob's daughters for a few years. sorry for the hijack

Make all dwi's a felony, even if it's the first offense. That will clean up a lot of this drunk driving and buzzed driving crap that goes on.

Froggy, then you probably know who I am. I worked both places for Bobby. I always worked the night shift and did the closing. OMG, I can't stand to look at another clam, never mind cook them. ;D In the pot, it would be two for the customer and one for me. After cooking dozens and dozens of clams at Spilka's, I've had my share of them and will pass them up on a menu now. Just saw Bobby a few months ago. He's looking pretty tired. He's had his share of crosses to bear for sure. We had a nice talk about the good old days at both places. Told him he would be the only one I'd come out of retirement for if he ever opened another place and he told me I'd be the one he would be looking for if he did. Great guy! Do you happen to know Mark Stukey? PS: If you were at Spilka's for the Halloween parties then you should remember one year when the Energizer Bunny, with drum and all, took the Grand prize. That was me. Deserved it. Not an easy costume to wear all night long. And "yes" before Clipper and Frank get on my back for that one, I'm still going, and going and going!!!!!!!!!

Wow, Ralph and Thelma, you guys surprise me on this one. "the sentence a bit harsh." Now, without comparing the two cases, aren't you looking to have stricter laws on the books? That's what we come up with whenever a serious crime has been committed, for the Judges to start throwing the book at the scum on our streets. Again, without comparing the two cases, (and I do feel as you do about the DWI laws not being strict enough), I am elated that the punk attacking the Officer got 6 years. It's happening all over, not just here in Utica, where our Officers are being attacked or killed on a daily basis. To the point where enforcement agencies are out on the streets, even have posters in grocery stores (which I have never seen before), trying to recruit others for the job. Not too many want to face what's out there on the streets now and I can't blame them one damn bit. Nothing like it use to be. Sure as hell would not want another son or grandson going into that line of employment any more and for those that are, I am preaching to them to take an early retirement. Pretty ironic, when I was the one 19 years ago wholly supporting their decision to become Police Officers. My attitude has changed because of the attitudes of the scum on our streets today and also because of the general publics attitude toward our Police Officers. Why would I want my kids to possibly give up their lives for doing a job that you're damned if you do and you're damned if you don't? Too many sit in their safe little homes and are so quick to criticize the ones out there who are trying to keep their homes safe. Again not comparing the two cases, a strong message had to be given out that it will no longer be acceptable or will you just receive a slap on the hand if you injure an Officer in any way. It's been long overdue and it's about time the system is finally listening to us. I for one will continue to pressure the system to give out those stronger messages to all the scum on our streets no matter what the crime is. You do the crime, you do the time. The longer the better!!!!!!

Bobbbiez - Where did you get the idea I thought the 6 year sentence given to this punk was "too harsh"? You had to misinterpreted what I posted as if I was the Judge, I would have given him 20 years.
If parents can't teach their children to respect authority - especially Law Enforcement Officers - then the Courts have to do it by throwing the book at them every time one to these assault cases on an Officer comes before a Judge.
I totally agree with you. Being a Police Officer in today's society is tough enough without worrying about putting up with disreprest and a bullet in your back.
P.S. I just went back and read the post where I said I agreed with Ralph's statement.
WE WERE TALKING ABOUT THE CONVICTION FOR THE DWI DRIVER - NOT THIS TEENAGER SENTENCED TO 6 YEARS FOR ASSULT!!!!!!!!!

Hi Thelma, I took it when you stated to Ralph, "I totally agree," that you agreed with his whole statement which included, "a bit on the harsh side." Pretty sure he wasn't talking about the DWI case. Oh well, it's on him then.
