Despite the circumstances and his participation, or lack thereof, she is correct.
By doing nothing he remained almost as guilty as the rest and certainly should have apologized for his lack or action.
I did think that his sentence was a bit "lite".

Correct me if I'm wrong, but I remember reading someplace that Stolarcyk did NOT take an active part in the beating and has been in jail awaiting his Trial for almost a year. This is why he was given the Sentence to "time served" - one year.
Yes, I do realize he is morally guilty as he did nothing to help Hill out either. But, the legal system has taken a different viewpoint and I guess "moral standards" don't come into play in a court of law.

Yes, Stolarcyk did not take part in the assault. The dead victim Hill had started the whole sad episode by blind-siding Stolarcyk in the head with a wooden spindle. The beating took place while Stolarcyk was inside the house tending to his wound. When he came back outside, he asked who had hit him. Someone pointed to Hill laying on the ground, perhaps already dead. Stolarcyk walked over to him and kicked him.
I think the OD's reporting on the apology this week was a little bit lacking. The way it read in the Rome Sentinel, it sure sounds like Stolarcyk was including himself when he talked about people making the wrong decisions that night in his apology.
I've written a letter to the DA asking him to explain his remarks that were printed in the Rome Sentinel the evening when the case ended. I'll be interested to see if he ever responds to me.

Swimmy - you described our local newspaper to a "T" - I call it nothing more than a "rag sheet" that contains mostly local gossip and distortions of the truth!
When are they going to wake up and realize that as long as people like me and many others don't pay for subscriptions to their "rag sheet" they will eventually have to close up their operations.

I looked at the Rome Sentinel today, yes I know that news paper is garbage. What I don't understand is that they always put Kevin on the front cover throughout this whole thing. Why was Cory, and John's article on the second page and not even mentioned on the first page of the Sentinel? Cory was the one who admitted to hitting Carl with the pool ball in the sock, and it was his idea to have a pool ball in the sock. You would think that it would be made into a big deal with Cory going today, and the girlfriend of Carl yelling at Cory. I just don't get it.

lucy, it looks like fighting school board members knocked fighting drunks off the front page of the Sentinel. Been there. Done that. BTW, still no answer to my letter to the DA. He called while I was out of my office last week and I've left him two voice mails since then.

Just trying to catch up on what I missed over the past few days. Thelma, the general rule is that unless you create the danger, you have no duty to rescue someone or pull them out of danger. If you think about it, if the law was different, then you could go to jail every time you passed by a car pulled over to the side of the road or didn't dial 911 after witnessing a car accident. Then of course there is the homeless who often starve to death...
Though, I agree with the moral high grounds. You should strive to help those in peril.

Swimmy - If this is true - then why have I read about people that have been arrested for NOT stopping someone who commits suicide?
In otherwords, IF you and I were in the same room and you were holding poison and telling me that you were going to take the poison and commit suicide. IF I did not try to stop you, I would be held responsible and subject to arrest.
SO - where is the difference between not coming to the aid of someone being beaten to death by a group of men?

As I said, "generally". The best explanation I can offer, without doing any research is that there is a statute out there making it a duty for someone to talk down a person from committing suicide. Otherwise, your guess is as good as mine.
