Me to Swimmy. It's an extremely hard situation when you're in the justice system some how and a family member gets in trouble and he has double-the-trouble. He just has to continue his work and realize his family is not the only ones who have had to overcome such an ordeal. In time, this to shall pass.

Dave, I don't necessarily disagree with Kracker's statements either. I should have prefaced my response with the fact I was playing devil's advocate. But there have been many a time when the DA has gone forward with less than credible evidence despite knowing a conviction was impossible. That's true, DA is an elected position. At least sometimes he has to play to the crowds, and all the time play a political game. But in this case, if he's playing a game, it would be a dangerous one since it involves other lawyers and a judge's family. Hard to imagine the DA is gambling on anything less than a sure bet.

Hard yes, but so far they have only been charged, right? There is no indictment against either. So the DA really isn't doing anything yet. I'm sure they're waiting until a special prosecutor is appointed, to avoid any impression of impropriety.

I bet it has been swept under the rug. Heads would roll if this got into the courts.

I doubt that anything either of these cases will be "swept under the rug." I don't think the public or the media would allow that. I would imagine that the legal wrangling and jockeying for position is going on as we speak. There will have to be much more investigation and much more factual information brought forth before I would form an opinion of guilt or innocence in the rape case. There is something that just doesn't set right about both of these cases in my mind. I am sure the cases are definitely proceeding through the justice system, and with further investigation, they will be adjudicated at some point.
It is much more imperative that the outcome be fair, more so than swift.

Fairness and justice do not always go hand in hand.
I doubt it will be swept under a rug. But I wasn't sure if anyone heard anything more, like whether either case has gone before grand jury.

I am far removed physically from the Utica area Swimmy, but I do track the news very closely through all the media outlets that I can access on the web, and have not seen any new developments reported by any of the news sources that I track, originating in Herkimer, Rome, Syracuse, and Utica, both newspaper and television station homepages.
