Grand jury is a good move and a coup on the defense's part. After you have sat through cases on a grand jury, it would be hard to indict a cop. They're the heroes.
Even if the jury believes the arresting officer and the evidence, jury nullification is quite possible, I'd think. I would, especially given the potential punishment. A-hole or not ... and I certainly don't know that, having never met the man ... I'd be really reluctant to bring that much punishment on the head of a 20 year SP veteran for a .09. I'd probably no-bill him.
I have never been friends with many cops (sorry to those here), but these are guys and girls we ask to step in front of bullets for us.

Hell no Dave, I'm not being cranky. You'll know when I'm really cranky. I can promise you that. Just saying it like it is. When we have a topic of an officer doing wrong many reply and some say the same old things over n over again but do nothing to help change things, but I have yet to hear the same people quickly reply and give out any accolades when an officer goes beyond his call of duty. Just take a look at the topics of the good officers do for their communities or topics concerning the deaths of officers who were doing their jobs in protecting all of us. The proof is in the fact these same people avoid acknowledging the good. It's that simple. Besides, I'm leaving for Jamaica this coming Monday and "no one" can get me cranky. My smile is from cheek to cheek. ;D

I just read in (Tuesday) yesterday's OD about a man in Ilion arrested for the same "exact" charges and it's this little article in the local section. No history given on the man, no big headlines and it didn't reappear in today's paper. Did the police wait outside his home for three hours so that the validity of any breathalyzer results could be challenged in court?

WKTV now reporting that his lawyer says Sullivan was stopped, NOT arrested, and continued home. He called others for advice and then took himself to the barracks, where he was then arrested. He evidently felt himself free to leave the scene, because he was not arrested. And the arraignment was postponed today because the Breathalyzer report was not available. I'm really looking forward to the explanation for how someone can be magically un-arrested for DWI. You know, get pulled over by a trooper, ticketed for multiple crimes, and then drive off for a couple of hours before wandering into a police barracks where the real arrest occurs. Do you need pixie dust for that kind of magic trick? Or just an extra-big helping of cynicism?

What we really need to do is just rewrite our laws so that serving law enforcement officers are exempted. That way we can be above board about there being two separate legal systems- one for regular people and one for the selected few.

Guy with a little mustache? Gear, I'm putting myself in the place of what I think would be a typical juror. Some years ago, I was on a grand jury where we no-billed a DWI defendent (so this was a second offense, a felony) who was clearly guilty. But we just didn't like the arresting cop (who was off duty) or the way in which the arrest took place.

Well .... I'll try. I'm making this up, of course, but my best guess is that here we had what can be called a Testosterone Hissy Fit... roadside arrest version. When it occurs between two cops, nobody does anything official until later, when everyone reaches a consensus of how to explain the encounter. Sort of like the truth isn't good enough, so instead they produce a storyline. Usually people like sergeants, captains, union reps and ADA's want to weigh in on the script. The first order of business at the script meeting is to decide how much each participant's vote weighs. That can result in an endless circle of testosterone fulmination, so then even more backup creative help is called in. That's what takes so much time.
The late breathalyzer "certification" may be that someone "forgot" to sign it and, before he does, they're researching whether or not his signature needs to contain his middle initial.

Hmmm. The pool of educational resources is getting rather small on here. I learned everything I know from FRANK AND DAVE! If Frank comes on here and says he learned it all from me and Dave, we really are going to have to take a serious look at expanding our horizons, jeeez. Does it help any that I have also take post grad short courses from Swimmy and Ralph?
