Looks like the Mayor overstepped his authority with his law restricting the size of sugary beverage containers. I thought it wrong that he based much of his justification on information provided by a health board that he himself appoints. I am not surprised that when it was brought before a judge, the judge ruled against it's implementation. online.wsj.com/article/SB10001424127887323826704578354543929974394.html

Not surprised here, either. This could be a significant decision, because it was based on Bloomberg's trying to make an end run around the people's duly elected representatives when by fiat he had his Health Board, as you pointed out, direct the banning of soda in cups exceeding 16 ounces. Let's hope Albany ... the land of the Great Back Door ... is listening. Bloomberg's action also appeared a tad unconstitutional! I hope other courts get to that aspect of it. The mayor's lawyers said they would appeal.
