www.uticaod.com/topstories/x1852606944/Pacherille-Sr-now-charged-with-harassing-judge-in-son-s-Cooperstown-caseDear old dad is not accepting the fact that his kid perpetrated a heinous act on an innocent young man, and has been convicted and sentenced for that crime. The more I read about the father, the easier it is to understand where the boy might have gotten his ignorance and racism. Not a bright thing to do, harassing a judge. Who do you think is going to win in a situation where you harass law enforcment or officers of the court? Not much to be accomplished here. They damn sure aren't going to overturn the sentence unless it is done on a legitimate appeal. Certainly won't be accomplished by going to the judge's home or picketing his house. Not the kind of publicity he should be seeking. Seems like it would have a negative impact on any efforts to resolve any issues in his favor.

The guy has some real issues. What makes him think he can hold a protest on the private property of a public official? That's not free speech, it is harassment and trespassing. Policelli is an asshole. Met him once or twice. He wants to spin this as a "free speech" issue when it is not. He's got no business on the private property of anybody, least of all a judge. He keeps this up and he might be sharing a cell with Jr.

A great attorney once said, "No matter how vile the defendant, and no matte how unpopular the argument, as an officer of the court and champion of the Constitution, it is an attorney's duty to present the best possible defense for that defendant, or justice is not done." I cannot remember who said it. But reminding myself of that quote is the only way I can sleep at night, sometimes.
Is Policelli an asshole? Perhaps. I only met him once and he was pleasant with me, so I'm not qualified to make that determination. But he cannot be faulted for executing his ethical duties to zealously represent his client's best interests.

There is a difference representing a client and making baseless claims that Pacherille's right to free speech is being denied.

Firstamendment, I think we need to agree to disagree on this one. As long as there is some merit, which, from a defense attorney's perspective, there is some, then Policelli is obligated to make that argument. I agree with you that there totally is no persuasive argument, and parcherille's claim will be defeated, ultimately. However, Policelli is ethically obligated, and probably morally obligated as well, to provide parcherille the best defense possible.

This guy is the kind of nutjob that is capable of shooting the judge or prosecutor when all else fails. He seems to me to be somewhat whacked.

I retained him once for a legal matter. He was a bit arrogant and didn't do much, if anything.
