Swimmy - What is a Error 440 that needs to be filed with the Court when they have made a mistake?
Is this a Motion that can be made by an individual or is it someone that only a lawyer can file with the Court?
I've tried to research this myself but the only Err0r 440 I can find is various tools to clean up a computer with.
Thanks for any help you can give me.

I've never heard of an Error 440. I've heard of a 440 motion in criminal law. It's based on CPL 440 to set aside a verdict, or other judgment. You don't have to be a lawyer to file one. There are forms from Mathew Bender's Forms that you can use. Is that what you're talking about? I will look into it tomorrow and get back to you.
The only time I've dealt with Error 440 is when I navigate to a non-existent web page.

I believe CPL 440 is what is needed, Swimmy, and I thank you for your help. Maybe, this is why I couldn't find it in the computer - I was inputting "error 440"!!!!!!

Hahaha. That'll happen. I can't tell you the number of times I searched for something only to realize I entered the wrong terms. If you go to the law library on Elizabeth street and ask where to find a sample 440 motion, the staff will be very helpful in assisting you. Each member of the law library is amazing, resourceful, pleasant, and helpful. Whenever I've needed to find some obscure text for my legal research, they've been able to help me find it.
