I find it's a common trait among criminal defense attorneys to keep showing that their case has merit and the jury got it wrong. I don't know how many of you followed the Kevin Porco case from Albany. Kevin was convicted of murdering his father and attempted murder of his mother. The whole case had to be transferred to a different judicial district because his father worked in the courthouse. To this day, his defense attorneys argue about his innocence in the matter and that kevin porco is a victim of the state singling him out because they had to find someone to convict for this heinous crime.
I imagine it's no different than a prosecutor insisting someone is guilty despite the verdict. For example, O.J. Simpson.

I've never placed much faith in the Criminal Justice system. People are more focused on making someone pay, than finding out what really happened. I don't know anything about the Molina case other than he was accused of shooting Officer Lindsey. If he did do it, they should have given him the death penalty because not only did he kill a HUMAN (not just a police officer) but he killed him in cold blooded execution style. His only intent was to kill Thomas Lindsey, not hurt him or scare him. If he is innocent the city needs to find the person that did this because a crime of this nature is unacceptable.

People are more focused on making someone pay, than finding out what really happened. That's why I advocate making a district attorney an appointed position. It takes the politics OUT of the legal system in terms of getting convictions to have a better record to be re-elected. There is no more death penalty in NYS. After Officer Corr and Officer Lindsey were killed, there was talk about instituting a death penalty for killing police officers.

I agree swimmy. There is no room for politics in the justice system. All judges and DA's need to be free and clear of political taints. I don't know exactly how one could take politics out of "appointments" either, unless God makes the appointments. LOL. Patronage is alive and well, so it would also taint an appointment process, and add bias to the justice system.

In an ideal world, or I guess a Utopian society, there would be no politics whatsoever. However, in the real world, the best we can do is to minimize the politicking by having an appointment process that does not lose sight of the fact that the appointment should be on qualifications for the job, similar to the Committee on Judicial fitness. That committee screens judicial candidates looking to run for trial judge in NYS (not a village or town justice of the peace) to see if they have the experience and competence to be an asset to the bench. Some of the judges currently sitting might not fit that qualification depending on your viewpoints, but its less political than say nominating a Supreme Court Justice.

So THAT's what's wrong at the federal level! I'd forgotten Rudy Guliani and all. Well ... it no doubt takes place at the local level, too, since the DA's office in any county is certainly not A-political. I'm not sure if elected or appointed would work best, but I got a hot flash when you mentioned "appointed." Must be the self-governing streak in me.
